Patent war: Samsung can not count on the help of Obama

Legal: If the Obama administration had vetoed an import ban on Apple for patent infringement, however it considered that such a prohibition applied this time Samsung was legitimate.
In August, Apple won a battle against Samsung in the ITC (International Trade Commission), an American authority. The manufacturer has indeed obtained a ban on imports of older models of smartphones and tablets made by rival Galaxy.
To escape the ban, Samsung could still count on the intervention of the Obama administration. The latter had already put his veto in a similar case, still before the ITC.
Apple applauded the "defense of innovation"
It was then that Apple was under a ban on sale of old iPhone and iPad in the United States due to patent infringement. But veto in favor of Apple , Samsung will not benefit.
"After carefully weighing the policy considerations, including the impact on consumers and competition, advice agencies and the information provided by the parties involved, I decided to allow the import ban" ruled a spokesman for the U.S. administration, told Bloomberg .
To oppose this decision, however, Samsung can still bring the case to an appellate court, which would then rule on the legality of the import ban, the scope of which should in principle be limited since it does not affect the latest and most popular devices manufacturers.
